Colorado Adopts Additional Rules Regarding Remote Notarizations

Following the temporary regulations previously adopted in response to the COVID-19 crisis, the Colorado Secretary of State recently issued additional temporary and permanent regulations regarding the requirements for the state’s authorization of remote notarizations.  The Colorado Secretary of State also simultaneously adopted permanent amendments to existing rules in order to ensure the uniform and proper administration, implementation, and enforcement of the Colorado Revised Uniform Law on Notarial Acts.

The regulations establish requirements and procedures regarding remote notarizations, including, but not limited to, audio-video communication technology, fees, identity verification, and electronic record storage requirements.  Although the new regulations will become temporarily effective on December 31, 2020, they will become permanently effective twenty days after publication in the Colorado Register.
