NY Temporarily Tolls Statutes of Limitations and Suspends Court Filings in Foreclosure and Eviction Proceedings in Response to Coronavirus
On March 20, 2020, the governor of New York issued an executive order concerning the limiting of court operations to essential matters during the COVID-19 health crisis. In pertinent part, the executive order tolls all specific time limits for legal matters until April 19, 2020. In accordance with the executive order, the New York courts suspended court filings except in essential matters, as specifically set forth in the order. Foreclosure and eviction proceedings are not essential matters listed in the court order.
In addition, the executive order specifically forbids enforcement of any residential or commercial foreclosures or evictions for ninety days.
