DC Amends Regulations Implementing Remote Notarizations

The District of Columbia recently amended the District of Columbia Municipal Regulations to implement statutes related to remote online notarizations.  The regulations became effective on November 3, 2023.  

Under the new regulations, before a notary public performs their initial remote notarial act, the notary public must notify the Office of Notary Commissions and Authentications in writing that they will be performing notarial acts with respect to remotely located individuals and must identify the technologies the notary public intends to use.  The regulations also set forth certain standards for identity proofing and standards for communication technology, as well as certain record-keeping requirements.
