FDIC Releases Enforcement Actions Manual

On December 2, 2019, the FDIC posted its full enforcement manual to its website to provide greater transparency regarding the FDIC’s enforcement program.  According to Financial Institution Letter (FIL-76-2019), the manual “provides direction for professional staff related to the work necessary to pursue formal and informal enforcement actions” and “is intended to support the work of field office, regional office, and Washington office staff involved in processing and monitoring enforcement actions.”  Finally, FIL-76-2019 states that the manual does not interpret any law or regulation and does not establish supervisory requirements or industry guidance.
