Georgia Amends Recording Requirements
Governor Brian P. Kemp signed into law HB 974 which revises the provisions regarding the recording of certain documents, including deeds, mortgages, and liens.
The bill provides that certain information be provided for the document on the first page of the document to be recorded, including, but not limited to, the date of the document, names of the signatories, parcel identification information, as applicable, the original loan amount, and the initial maturity date.
The bill also requires that the superior court’s clerk’s office provide a public computer terminal with access to the Georgia Superior Court Clerk’s Cooperative Authority’s electronic filing portal.
These provisions become effective on July 1, 2023. The bill can be found here.
