Idaho Amends Notary Law to Allow Remote Notarizations
On March 21, 2019, Idaho Governor Brad Little signed into law Senate Bill 1111 (SB 1111), which amends Idaho’s notary statute. SB 1111 establishes the requirements for conducting electronic notarizations and remote notarizations in Idaho.
Some of the key provisions of SB 1111 include the following:
- Authorizes notarial officers to certify that a tangible copy of an electronic record is an accurate copy of such electronic record;
- Authorizes notarial officers to conduct remote notarizations using communication technology;
- Specifies the requirements for conducting remote notarizations;
- Requires notarial officers to retain an electronic audio-visual copy of the performance of each notarial act using communication technology for 10 years from the date of performance; and
- Allows a notarial officer to select one or more tamper-evident technologies to perform notarial acts on electronic records.
The changes made by SB 1111 go into effect on January 1, 2020.
