Illinois Modifies Fees and Costs Included in Confirmation Orders

The Illinois legislature recently enacted Senate Bill 255 (SB 255), which modified the fees and costs that can be included in confirmation orders that are issued in connection with foreclosures in Illinois.  Specifically, effective July 9, 2021, SB 255 expanded the fees and costs that can be approved in a confirmation order to include those incurred by a mortgagee on or after the execution date of the prove-up affidavit and prior to the entry of judgment, but not included in the judgment.  A copy of SB 255 is available here.
