Illinois Revises Provisions for Recorded Instruments

Illinois adopted changes in May to its requirements for the recording of deeds and other instruments.  Under the revised Counties Code, a physical or electronic image of the recorder’s stamp may now also satisfy the signature requirement for recorded instruments, including for instruments recorded prior to the May effective date of the amendment.  This applies for, among other things, the recording of mortgages, leases, and liens.
