Indiana Revises Code for Recording of Instruments

With the passage of HB 1056, Indiana recently added new sections to its Code concerning the recording of documents, either in electronic format or paper format. These amendments are effective immediately.

The new sections are designed to conform with Indiana Senate Enrolled Act No. 340, requiring that any document to be recorded have both a notarized signature of the grantor and a notarized signature of a witness.  HB 1056 provides specific requirements for such documents to be recorded, including those that are notarized electronically and further adds certain instances for when an instrument is considered validly recorded for purposes of providing constructive notice.
