New Louisiana Law Determines Parish of Execution for Online Notarial Services
Louisiana recently enacted a law that changes the place of execution of a remote online notarial act to be the parish in which the notary public is physically located at the time of the notarization as long as the notary public has jurisdiction in that parish.
Previously, the place of execution was the parish in which any party was physically located at the time of the notarization, and only if no party was present in Louisiana at that time would the place of execution be deemed to be the parish in which the notary public was physically located.
An action on a contract that was remotely notarized online may still be brought in any parish in which a party was physically located at the time of the notarization.
The new law takes effect August 1, 2022.
