State Regulatory Developments

Reminder: California DRE to Require Implicit Bias Training Beginning Jan. 2023

California Senate Bill 263 (SB 263), which the California legislature passed last fall, added new training requirements for real estate broker and real estate salesperson licensees and applicants. Applicants for the real estate salesperson license will now be required to take a fair housing course, and real estate broker applicants (first time and renewals) must take courses on implicit bias as well as on state and federal fair housing laws. These courses will be included in the 45-hour continuing education requirements for real estate broker license renewals.

The law includes certain components that must be addressed in the training, including actionable steps licensees can take to recognize and address their own implicit biases.

The new requirements take effect January 1, 2023. The California Department of Real Estate has indicated that they are working with private course providers on the new requirements and expect to post updated information on their website soon.
