Virginia Adds Buyer Beware Disclosure Regarding Lot Lines
Virginia bill H.B. 702, which was passed by the Virginia legislature this spring, recently took effect. The bill adds a new section to the required ‘buyer beware’ disclosure that must be provided by an owner of residential real property to a purchaser. The disclosure must now include a statement that the owner makes no representation with respect to current lot lines or the ability to expand, improve, or add any structures on the property. The disclosure further advises purchasers to exercise due diligence, including by obtaining a property survey and contacting the locality to determine zoning ordinances or lot coverage, height, or setback requirements on the property.
The bill took effect July 1, 2022. The Virginia Real Estate Board has updated its disclosure forms, available on its website.
